Terms and Conditions for Use of Press Lounge

General

This Press Lounge is a secure portal intended to be a central source for Toshiba partner news and relevant sales, services, marketing and event information. It also supports a number of additional services. The availability of these resources and additional services to an individual user is dependent on the account to which that user is allocated.

Your Account

For this Press Lounge you will need – depending on your country – to register with your contact details and/or other data. Please make sure that the details you give us are correct and complete. You can access and update much of the information you provided with My Account. You are obliged to update your Account in the event that anything changes.

For storage of personal information please have a look at Toshiba's privacy policy on www.toshiba-teg.com. If you use the Press Lounge, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer in order to prevent unauthorised access to your account. You agree to accept responsibility for all activities that occur under your account or password. You should take all necessary steps to ensure that the password is kept confidential and secure. Please inform us immediately if you believe that your password has become known to anyone else, or if the password is being used in an unauthorised manner.

Toshiba further reserves the right to refuse access to the Press Lounge or terminate accounts upon its own discretion. Toshiba reserves further the right to take legal steps if infringements of these terms and conditions are suspected.

Warranties

The information is provided "AS IS" with no implied or other warranty. Toshiba does not give any warranty as to the accuracy, reliability, or completeness of the information and accepts no responsibility for updating or correcting any part of the information. While we have taken all reasonable care in producing the information contained on the Press Lounge, we do not promise that it contains all the information you need to answer all your questions.

Toshiba's obligations with respect to its products and services are governed solely by the agreements under which they are provided and nothing on the Press Lounge should be construed to alter such agreements. Toshiba may make changes to the materials and services, or to the products and prices described in them, at any time without notice. The materials and services on the Press Lounge may be out of date, and Toshiba makes no commitment to bring up to date the materials and services on the Press Lounge. Information published on the Press Lounge may refer to products, programs or services that are not available in your country. Consult your local Toshiba business contact for information regarding the products, prices, programs and services that may be available to you.

Ownership, Use and Intellectual Property Rights

The Press Lounge and all content within the Press Lounge is owned and operated by Toshiba and/ or its licensors. Toshiba and its licensors reserve all its rights. The Press Lounge is for your use only.

Any intellectual property rights (including without limitation all patents, copyright, database rights and trademarks –whether registered or unregistered– subsisting in any content or material on the Press Lounge belongs to Toshiba and/ or its licensors.) All rights are reserved for the benefit of Toshiba and/ or its licensors. Nothing in these terms and conditions grants you any rights in the Press Lounge or the content within the Press Lounge.

Links to third–party Websites/Services

Links on the Press Lounge to third–party websites or services are provided solely as a convenience to you. If you use these links, you will leave the Press Lounge. Toshiba has not reviewed all of these third–party sites or services and does not control and is not responsible for any of these sites or their content. Therefore, Toshiba does not endorse or make any representations about them, or any information, software or other products or materials found there, or any results that may be obtained from using them. If you decide to access any of the third–party websites or services linked to the Press Lounge, you do this entirely at your own risk.

Limitation of liability

In no event will Toshiba, its suppliers or other third parties mentioned on the Press Lounge be liable for any damages whatsoever (including without limitation, those resulting from lost profits, lost data or business interruption) arising out of the use or inability to use the Press Lounge.

Use of material (data sheets/price lists/press materials/photos/videos)

You may use the material solely for commercial use. This right to use is personal to you and is not transferable by you to another party. You may not alter, or modify the material, in whole or in part, for any reason. Toshiba is and shall remain the sole and exclusive owner of the material.
The material is provided by Toshiba on an 'AS IS' basis, without warranty of any kind, including non–infringement or ownership.

Other materials which are marked as NDA can be only used for internal purposes. You are not allowed to distribute the NDA marked material or make it available to third parties.

Confidentiality of "Private Area"

The private area of the Press Lounge is only accessible upon permission of Toshiba. To get permission for the private area you will need to sign a Non Disclosure Agreement.

Governing Law

Should any part of these terms and conditions for any reason be declared invalid or unenforceable by a court of a competent jurisdiction, it shall be deemed to be deleted without affecting the remaining provisions.

These terms and conditions are governed and construed in accordance with the laws of the Federal Republic of Germany and you consent to the exclusive jurisdiction of the courts of Düsseldorf.
